this case monsanto not party, alleged have been involved in events under dispute. in 1997, news division of wtvt (channel 13), fox–owned station in tampa, florida, planned air investigative report steve wilson , jane akre on health risks allegedly associated monsanto s bovine growth hormone product, posilac. before story air, fox received threatening letter monsanto, saying reporters biased , story damage company. fox tried work reporters address monsanto s concerns, , negotiations between fox , reporters broke down. both reporters fired. wilson , akre alleged firing retaliation, while wtvt contended fired insubordination. reporters sued fox/wtvt in florida state court under state s whistleblower statute. in 2000, florida jury found while there no evidence fox/wtvt had bowed pressure monsanto alter story, akre, not wilson, whistleblower , unjustly fired. fox appealed decision stating under florida law, whistleblower can act if law, rule, or regulation” has been broken , argued fcc s news distortion policy did not fit definition. appeals court overturned verdict, finding akre not whistleblower because of florida legislature s requirement agency statements fit definition of “rule” (must) formally adopted (rules). recognizing uncodified agency policy developed through adjudicative process equivalent of formally adopted rule not consistent policy, , expand scope of conduct subject employer liability beyond florida s legislature have contemplated when enacted whistle-blower s statute.


industrial bio-test laboratories scandal

in 1981, 4 executives of industrial bio-test laboratories(ibt), american contract research organization indicted in federal court on various counts including scientific misconduct , fraud, , convicted in 1983. ibt industrial product safety testing laboratory used pharmaceutical companies, chemical manufacturers , other industrial clients, operated 1 of largest facility of kind in us, , performed more one-third of toxicology testing in united states. 1 of convicted executives paul wright, toxicologist, had spent 18 months @ ibt in 1970s while ibt testing antimicrobial product monsanto developing, triclocarban(tcc). revelations of misconduct ibt labs led establishment of laboratory practice standards , regulations industrial testing.


in 1991, philip smith, former assistant toxicologist @ ibt, testified in trial in monsanto being sued workers @ westinghouse on pcbs, final toxicology reports on pcbs provided monsanto ibt contained falsified data.

in late 2006, correctional tribunal of carcassonne, france, ordered 2 directors of monsanto subsidiary asgrow pay €15,000 fine related knowledge of presence of unauthorized genetically modified organisms (gmos) in bags of seeds imported asgrow on april 13, 2000.
